Acceptance of Terms
By accessing and using Smile Mall (smilemall.zb.co.zw), operated by ZB Financial Holdings Limited, you agree to be bound by these Terms of Use. All users of our online services are subject to our Data Protection & Privacy Statement and agree to be bound by these Terms. If you do not agree, please do not use the platform.
About Smile Mall
Smile Mall is an online marketplace and bill-payment platform operated by ZB Financial Holdings that connects buyers with verified merchants across Zimbabwe. Through the platform you can shop for goods, pay bills such as ZESA, DStv, and council rates, buy airtime, and access ZB financial and digital services from one place.
User Accounts
You may be required to create an account to access certain features. You are responsible for providing accurate information, for maintaining the confidentiality of your account credentials, and for all activities that occur under your account. You must notify us promptly of any unauthorised use of your account.
Intellectual Property Rights
Copyright and other intellectual property rights exist in all the contents of this platform. All these rights are owned by or licensed to ZB Financial Holdings Limited. You may download or print platform contents owned by ZB Financial Holdings Limited only for your own personal, non-commercial use, or for other legally permitted purposes. You may not link to or frame this platform without ZB Financial Holdings Limited's prior written consent.
Purchases and Payments
All purchases and bill payments made through Smile Mall are subject to availability and acceptance of your order. Payment processing is handled through ZB Financial Holdings' secure payment infrastructure. Prices and any applicable fees are displayed before you confirm a transaction. You agree to provide accurate payment details and to pay all charges you incur.
Merchant Responsibilities
Merchants on Smile Mall are responsible for the accuracy of their product and service listings, the fulfilment of orders, and compliance with all applicable laws and regulations in Zimbabwe. Merchants must honour the prices, descriptions, and delivery commitments they publish on the platform.
Acceptable Use
You agree to use Smile Mall only for lawful purposes. You must not use the platform to engage in fraud, infringe the rights of others, upload malicious code, attempt to gain unauthorised access to our systems, or interfere with the operation of the platform or other users' use of it.
Limitation of Liability
Smile Mall acts as a marketplace and payment facilitator. To the extent permitted by law, we are not liable for the quality, safety, or legality of items sold by merchants, the accuracy of listings, or the ability of merchants to complete sales. Nothing in these Terms excludes liability that cannot be excluded under applicable Zimbabwean law.
Governing Law
These Terms of Use are governed by the laws of Zimbabwe, and any disputes arising from your use of Smile Mall are subject to the jurisdiction of the Zimbabwean courts.
Changes to These Terms
We may update these Terms of Use from time to time to reflect changes to our services or the law. Any changes take effect when we publish the updated Terms on this page, and your continued use of Smile Mall constitutes acceptance of the revised Terms.
